The Collective Labour Agreement No. 85a (27 February 2008), concluded within the National Labour Council amends the collective labour agreement No. 85, 9 November 2005 on telecommuting (registered on March 10, 2008 as No. 87289 / CO/300).
This last modification tends to resolve the problem of industrial accidents occurring during telework and the burden of proof in cases of labour accidents in the workhours at home or telecommuting.
"(…) Whereas in the latter view, it is proposed to introduce a law of 10 April 1971 on accidents at work a presumption of execution of contract work for teleworkers to reduce the burden of proof in accidents at work in regard to them (…) ".
